Why in the News?

The Assam Cabinet on 24 September 2026 approved the Assam Muslim Marriage Registration (Compulsory) Rules, 2026, establishing a uniform procedure for compulsory registration of Muslim marriages across the State.

The new rules operationalise the Assam Compulsory Registration of Muslim Marriages and Divorces Act, 2024. Muslim marriages will now be registered through government-appointed registrars, replacing the earlier system involving licensed Muslim registrars, commonly known as qazis.

The move is aimed at creating a formal government record of marriages and ensuring a standardised registration process across Assam.

From the 1935 Law to the 2026 Rules

The present framework is the result of a gradual legal transition.

• The Assam Muslim Marriage and Divorce Registration Act, 1935 provided the earlier legal framework for registration through licensed Muslim registrars.
• A 2010 amendment made registration of Muslim marriages and divorces compulsory under the earlier framework.

Therefore, the 2026 Rules do not introduce compulsory registration for the first time; rather, they establish the operational mechanism for the framework created by the 2024 Act.

What Does the 2024 Act Provide?

The 2024 law requires Muslim marriages in Assam to be registered, subject to the provisions specified under the Act.

The framework includes several safeguards:

• The woman must be at least 18 years old and the man 21 years old at the time of marriage.
• Applicants have to provide prescribed identity, age and residence documents.
• The process requires declarations relating to the marriage and the parties.
• The framework provides for public notice and a 30-day objection period before registration.
• Conditions relating to free consent and prohibited relationships are also incorporated.

The law also seeks to prevent the registration of marriages involving minors.

Why Is Marriage Registration Important?

Marriage registration provides an official documentary record of a marriage. Such documentation can be important in matters involving marital status, inheritance, maintenance, legal claims and access to government or administrative services.

It can also make it easier for authorities to verify the age and identity of the parties, thereby strengthening safeguards against child marriage.

An important distinction for examination purposes is that marriage registration and marriage solemnisation are not the same thing. Registration is the formal recording of a marriage by the State, while solemnisation refers to the process through which the marriage itself is performed.

Who Will Implement the Rules?

The registration process will now operate through government registration officials.

The State Government has indicated that additional registrars may be appointed if the number of applications increases. This is important because a compulsory legal process must also remain accessible, affordable and convenient for citizens.
