Relevance: GS-III (Intellectual Property, Agriculture); GS-II (Inter-state Disputes) Source: GI Registry / Agricultural Updates, 2026

1 · What is the news?

Imagine working hard in the fields to grow a world-class crop, but a distant market takes all the official credit. A major dispute has started because the famous Geographical Indication (GI) tag for ‘Unjha Jeera’ (cumin) and ‘Unjha Saunf’ (fennel) was given to the Unjha market in Gujarat.
Here is the problem: Unjha is just a trading hub (mandi). The actual farmers who grow most of these spices live hundreds of kilometres away in Rajasthan. Because their local mandis lack good facilities, they travel to Unjha to sell their harvest. Now, Rajasthan farmers fear traders will use this GI tag to brand Rajasthan-grown spices as “fake” or “inferior” to reduce the farmers’ profits.

2 · Cultivators vs. Traders

Step 1: The Hard Labour
Farmers in Rajasthan grow vast amounts of Jeera and Saunf. Today, Unjha (Gujarat) actually grows very little of it.
Step 2: The Forced Journey
Because their local mandis offer poor prices, Rajasthan farmers travel 370 km to sell their produce at the Unjha market.
Step 3: The GI Tag Controversy
The GI Registry gave the prestigious tag to the Unjha market based on its “trading reputation”, leaving the real producers angry.
Step 4: The Demand for Justice
Experts argue that GI tags should reward the exact geographical area where the crop is grown, not just the middlemen who sell it.

3 · Key Legal Concepts

The GI Act, 1999
Origin vs. Market
A GI tag protects products whose special qualities come from where they are grown. Giving it to a marketing board sets a bad example for India’s Intellectual Property laws.
PPV&FR Act, 2001
Farmer as a Scientist
This law protects crop varieties invented by farmers. For example, a Rajasthan farmer bred a premium fennel variety. The broad ‘Unjha’ tag threatens the identity of this local innovation.
The Missing Link
Weak Local Mandis
This dispute shows a big policy failure. States must build good, local mandis so farmers don’t have to travel far and surrender the credit for their hard work to distant markets.
Ethical Lesson (GS-IV)
Protecting Genuine Merit
Just as farmers lose their rightful credit to powerful middlemen, our hardworking students often see their merit stolen by exam mafias. A fair democracy must protect genuine hard work.

UPSC Prelims Quick Facts: Intellectual Property
Geographical Indication (GI) A sign used on products that have a specific geographical origin (like Darjeeling Tea). The registry is headquartered in Chennai.
PPV&FR Act, 2001 Protection of Plant Varieties and Farmers’ Rights Act. It formally recognizes and protects the Indian farmer as a breeder and innovator.
APMC Agricultural Produce Market Committee. A statutory market board established by state governments to help farmers sell their produce fairly.

MCQ Practice Question
Q. With reference to Intellectual Property Rights and Agriculture in India, consider the following statements:

  1. A Geographical Indication (GI) tag is legally granted strictly based on the reputation of a trading or marketing hub, regardless of where the crop is originally cultivated.
  2. The Protection of Plant Varieties and Farmers’ Rights (PPV&FR) Act, 2001 allows farmers to register and protect new crop varieties they have bred.
  3. The Geographical Indications Registry is a statutory organization headquartered in New Delhi.

Which of the statements given above is/are correct?
(a) 1 and 2 only    (b) 2 only    (c) 1 and 3 only    (d) 1, 2 and 3

Answer: (b) 2 only

  • Statement 1 — Incorrect (the trap): A GI tag is tied to the geographical origin of production (where the crop is grown), not just the market hub. This is why the Unjha tag is being legally challenged!
  • Statement 2 — Correct: India’s PPV&FR Act is unique as it formally protects the intellectual property of a farmer acting as a breeder/innovator.
  • Statement 3 — Incorrect: The Geographical Indications Registry is headquartered in Chennai, not New Delhi.
