The News: The Supreme Court is questioning how a standard voter registration form got changed online, accidentally putting citizens at risk of breaking the law. During the hearings, judges also highlighted a surprising legal fact: India’s top election officials now have lifelong legal protection, a shield stronger than what the Prime Minister or Supreme Court judges get.

1. The Accidental Legal Trap

To get on the voter list for the very first time, citizens fill out a document called Form 6. Recently, many existing voters found their names mistakenly deleted from the voter list during a cleanup drive.

  • The Checkbox Problem: When these deleted voters went online to get their names back on the list, they had to use Form 6. But a new checkbox had been added, forcing them to declare: “I am applying for the first time.”
  • The Danger: Under our election laws, lying on a voter form is a crime that can lead to a year in jail. By forcing older voters to click “I am a first-timer,” the system accidentally made them break the law just to get their voting rights back.
  • Who Changed It? The Election Commission (EC) cannot change these forms on its own. By law, they need approval from the Central Government. The Supreme Court is now asking who exactly authorized this confusing change.

2. The Lifelong Legal Shield

While hearing this case, the Supreme Court discussed the new 2023 law that governs the Election Commission, pointing out a massive protection given to its leaders.

  • Absolute Protection: A judge pointed out that under the new law, the Chief Election Commissioner and other Commissioners are given absolute, lifelong protection from being taken to court for anything they do while in office.
  • A Rare Privilege: The judge noted that not even the Prime Minister or Supreme Court judges have this kind of permanent, blanket shield. In India, the only person with a similar level of protection is the President.
