1. What is the News?
Chief Justice of India (CJI) Surya Kant has stepped away (recused himself) from hearing a major case regarding how the Chief Election Commissioner (CEC) and Election Commissioners are appointed.
Why did he step away? He did this to ensure complete fairness. Since the new law directly involves removing the CJI’s role, hearing the case himself would look like a “conflict of interest.”
2. The Main Fight: Supreme Court vs. Government
To understand this debate, look at what happened in 2023:
The Supreme Court’s Rule (Early 2023): To keep the Election Commission completely independent, the Supreme Court ruled that a 3-member team should pick the Commissioners: The Prime Minister, the Leader of Opposition, and the Chief Justice of India (CJI).
The Government’s New Law (Late 2023): Parliament passed a new law that changed this team. They removed the CJI and replaced him with a Union Cabinet Minister.
Why are critics worried? Under the new law, the team is: PM (Chairperson) + Union Minister + Leader of Opposition. This means the ruling government has a 2-to-1 majority and can easily outvote the opposition to appoint whoever they want.
3. Constitutional Angles (For Your Mains Answer)
Free and Fair Elections: Article 324 gives the Election Commission the power to control elections. For elections to be truly fair, the people running them must be appointed through a neutral process.
Ethics (GS-4): The CJI stepping down is a perfect example of judicial ethics. There is a famous legal rule: “No one should be a judge in their own cause.”
The “UPSC Trap”
The “Selection Panel” Trap: UPSC will try to trick you by asking who is currently on the selection panel. Do not choose the CJI! Under the active 2023 Act, the panel only consists of the Prime Minister, the Leader of Opposition (Lok Sabha), and a Union Cabinet Minister.
