1. What is the News?

2. The Constitutional Debate
This case is a classic example of “Combative Federalism.” The main fight is over how the ED filed the case.
The State’s Argument (Use Article 131): * West Bengal argues that Article 32 is strictly meant to protect the “Fundamental Rights” of living citizens.
The ED is just an investigative agency, not a person. It has statutory powers, but no fundamental rights.
Therefore, if the Union government has a dispute with a State, it must file a suit under Article 131 (the Supreme Court’s original jurisdiction for Centre-State disputes).

The “Article 32” Trap: UPSC frequently tries to trick students by stating that Article 32 can be invoked for any legal dispute. Incorrect. It is specifically and strictly meant only for the enforcement of Fundamental Rights (Part III of the Constitution).
The “ED Ministry” Trap: Because the ED arrests people, it is easy to assume it falls under the Ministry of Home Affairs (like the CBI or police). Incorrect. The ED purely investigates financial crimes and operates under the Ministry of Finance (Department of Revenue).
