Context : Recently, political workers protested without shirts at an international event (AI Summit) held in India. Ruling leaders quickly called them “anti-national” and accused them of ruining India’s image in front of foreigners.
This sparks a very important debate : Does protesting in front of the world hurt the country, or does it actually prove that India is a free and healthy democracy?
- The Big Difference: State vs. Government
To write a good Essay or Polity answer, you must clearly explain the difference between the country and the people running it:
- The State (The Nation): This is permanent and supreme. It is India itself.
- The Government: This is temporary. It is just a group of people elected for five years to manage the country.
- The Danger: Powerful leaders often try to mix these two. If people are made to believe that the Government is the Nation, then anyone who criticizes a government policy is instantly branded as a traitor or an “anti-national.”
- What Does the Constitution Say?

- The “Safety Valve”: Think of a pressure cooker. It needs a safety valve to release steam so it doesn’t burst. In the same way, a democracy needs protests so citizens can release their anger and frustrations peacefully.
- What Does the Supreme Court Say?
The Supreme Court has always protected the right to protest:
- Kedar Nath Singh Case (1962): The Court clearly ruled that using strong, angry words to criticize the government and demand change is not a crime against the nation (sedition).
- 2018 Right to Protest Case: The Court stated that public protests are absolutely necessary in a democracy to hold elected leaders accountable.
- The Role of TV and Media
Today, modern media often acts like a loudspeaker for the government.
- TV anchors frequently issue “certificates of patriotism” to decide who is a true Indian and who is not.
- During major movements (like the Farmers’ Protest), parts of the media quickly accused the protesters of working for foreign enemies. This wrongly turns a normal protest over a policy into a test of national loyalty.
